The Bureau adopted the agenda.).

Exchange with Chairpersons of the Groups of Specialists of the CDMC

The Bureau held an exchange with Ms Zrinjka PERUSKO, Chairperson of the MC-S-MD, Mr Niklas KARLENDAL, Vice-Chairperson of the MC-S-IC, Mr Mark LENGYEL, Vice-Chairperson of the MC-S-PSM and Mr Thomas SCHNEIDER, Chairperson of the MC-S-IS. The Secretaries of the groups also took part in the discussion.

In summary, the Chairpersons and Vice-Chairpersons present reported that, on the whole, the groups found no problems or difficulties to implement their terms of reference, nor the need for significant clarification, and provided information on the timing of the expected output. The Chairperson of the CDMC underlined the need for the groups’ output to be distributed in time, in order to prevent difficulties towards the end of 2008 in terms of unfinished work or accumulation of texts or proposals for consideration by the CDMC. He also underlined the need for texts prepared by the groups to meet CDMC and CM standards to ensure their smooth processing and adoption.

The Bureau concluded that this type of exchange is highly desirable and that, resources permitting, participation of the Chairpersons of the groups of specialists in Bureau and/or CDMC meetings at regular intervals should be envisaged.

Preparation of the 5th meeting of the CDMC (12-15/06/2007) with reference to the CDMC’s provisional draft agenda

The Bureau agreed to submit to the CDMC the draft agenda for the Steering Committee’s next meeting subject to certain changes.
The Bureau took specific decisions and offered its views in respect of the following items.

a. Decisions of the Committee of Ministers of interest to the work of the CDMC
The Bureau decided that, in line with consistent practice to date, where appropriate CDMC opinions, comments and other documents should cite relevant case law of the European Court of Human Rights.

Following the Committee of Ministers transmission for information and possible comments, the Bureau decided that draft comments be prepared in respect of Parliamentary Assembly (PACE) Recommendation 1789 (2007) on Professional education and training of journalists by 15/06/2007.

Regard should be had in this respect to the comments received from CDMC members to date and those provided by the Bureau itself: addressing the very concrete proposals made by PACE; making reference to existing journalists’ training networks and examples of good practice, including within small groups of Council of Europe member states; making reference to work being carried out by the CDMC’s groups of specialists; highlighting the importance of the human rights education perspective, and addressing also new communication and information technologies and services, both as means for the dissemination of journalistic work, with new categories of professionals and different perceptions of professional ethics, and as a potentially very useful tool for journalists’ training and capacity building.

In anticipation of possible Committee of Ministers decisions to transmit other documents to the CDMC for information and possible comments, the Bureau decided that, if appropriate:
(i) draft comments be prepared on the Congress of Local and Regional Authorities of the Council of Europe Recommendation 211 (2007) on freedom of assembly and expression for lesbians, gays, bisexuals and transgendered persons, in light of comments provided by CDMC members;

(ii) draft comments be prepared on PACE Recommendation 1791 (2007) on the state of human rights and democracy in Europe;

in respect of PACE’s invitation to the Committee of Minister “to establish a specific mechanism on freedom of expression and media tasked with the specific mandate to monitor the situation of freedom of expression and of the media in Council of Europe member states and to suggest corrective measures” (paragraph 19 of PACE’s Recommendation), the Bureau considered it desirable that the CDMC be able to adopt a position on the matter at its next meeting;

(iii) draft comments be prepared on PACE Recommendation 1792 (2007) on fair trial issues in criminal cases concerning espionage or divulging state secrets:

The Bureau took note of the final versions of the CDMC comments on PACE Recommendations 1768 (2006), 1773(2006) and 1783 (2007); they will be compiled in document CDMC(2007)3 rev.

The Bureau also took note of other Committee of Ministers decisions, notably as regards the CDMC’s last meeting report, the adoption at the proposal of the CDMC of one declaration and two recommendations, as well as the new terms of reference of the CDMC’s subordinate bodies, and consideration to date of the CDMC’s report on the implementation of the Warsaw Summit Action Plan.

The Bureau left for later consideration, in particular by the MC-S-IC, the impact of the Committee of Ministers instructions (11 April 2007) to the Secretariat to establish an internet-based space where media professionals and other interested parties can exchange views on and discuss the challenges to freedom of expression and information in times of crisis (with reference to item 4 of the Kyiv Action Plan and the third item of the new terms of reference of the MC-S-IC). These instructions have already been welcomed by the CDMC when providing comments on PACE Recommendation 1783 (2007) on the threats to the lives and freedom of expression of journalists.

Follow-up to the monitoring procedure of the Committee of Ministers on freedom of expression and information

The Bureau expressed the view that, at present, no further action is required on this item in light of the Committee of Ministers instructions (of 24/11/2004) and the answers provided by the CDMC (reply on the alignment of the laws on defamation with the relevant case-law of the European Court of Human Rights, including the issue of decriminalisation of defamation; declaration on protecting the role of the media in democracy in the context of media concentration; recommendation on media pluralism and diversity of media content; declaration on the guarantee of the independence of public service broadcasting).

Nonetheless, the Bureau noted that the observer organisation Article 19 considers that defamation should be kept on the CDMC agenda; it encouraged Article 19 to express its views on the subject at the forthcoming Steering Committee meeting.

Discussions on the work of the CDMC subordinate bodies

(i) Group of Specialists on freedom of expression and information in times of crisis (MC-S-IC)
The Bureau noted action being taken or planned in respect of the group’s terms of reference (in addition to the two draft instruments considered under item 4.f. below) as follows:
(i) the elaboration of draft proposals for an informal web-based discussion space and network for the ongoing review by media professionals and other interested parties of the rights and responsibilities of the media and the working conditions of journalists in times of crisis and for the exchange of information and co-ordination of initiatives regarding the media’s contribution to inter-cultural and inter-religious dialogue (cf. items 4 and 6 of the Kyiv Action Plan)

(ii) the elaboration of draft proposals for an award for media which have made an outstanding contribution to conflict prevention or resolution, understanding and dialogue (cf. item 7 of the Kyiv Action Plan);

(iii) the elaboration of draft proposals for a possible Council of Europe coordinator for monitoring the implementation by member states of the texts adopted by the Council of Europe concerning freedom of expression and information in times of crisis (cf. item 8 of the Kyiv Action Plan);
in respect of this point, the Chairperson of the CDMC recalled his letter to MC-S-IC members, where he suggested that lower priority might be given to this task given the ongoing consideration by the CDMC of the desirability of establishing a more general monitoring mechanism for freedom of expression and information and freedom of the media;

(iv) the preparation of a draft document with a view to encouraging the training of media professionals with an emphasis on safety issues and on the importance of the professional and independent coverage of crisis situations (cf. item 5 of the Kyiv Action Plan);
one member of the Bureau indicated that it would be appropriate to link this last document to PACE Recommendation 1789 (2007) on the professional education and training of journalists

The Vice-Chairperson and Secretary of the group considered that the bulk of the output expected from the MC-S-IC would be delivered to the CDMC within 2007. However, they also indicated that the group’s work should be seen also in a longer term perspective and consideration might already be given to extending its terms of reference to 2008 (as matters stand, they come to an end on 31 December 2007).

(ii) Group of Specialists on media diversity (MC-S-MD)
The Bureau noted action being taken or planned in respect of the group’s terms of reference as follows:
(i) a detailed draft proposal for a methodology for the monitoring of media concentration and, if possible, for measuring the impact of media concentration on media pluralism and content diversity (cf. item 9 of the Kyiv Action Plan) will be prepared based on the results of a questionnaire to be addressed in due course to CDMC members; the Chairperson of the MC-S-MD indicated that the group was pleased that the idea of monitoring media concentration had not been rejected entirely by the CDMC;

(ii) monitoring of the implementation of Recommendation Rec(2003)9 of the Committee of Ministers on measures to promote the democratic and social contribution of digital broadcasting (cf. item 14 of the Kyiv Action Plan) will be pursued through the answers provided to a questionnaire that was sent to CDMC members some time back, with a view to preparing a compendium of good practices for member states in this field. At the same time, the MC-S-MD noted that the information gathered before its 5th meeting in April 2007 was insufficient for preparing such a compendium, as it was largely statistical. Consequently, the group agreed that it would be useful to obtain more information about positive practices established in a number of countries that were most advanced in terms of digital broadcasting;

(iii) while the group was not certain of what is the social cohesion and the integration of different communities (cf. item 13 of the Kyiv Action Plan) angle of some of the items under this heading of its terms of reference, it proposes (a) to explore the work being carried out by a number of organisations and engage a consultant with a view to the elaboration of a draft document/standard setting instrument in support of community, local, minority and social media, (b) having regard to existing good practices within certain media organisations, prepare a draft document/standard setting instrument on the ways in which the public can be involved in consultative programming structures, and (c) draw up a draft document/ instrument on the importance of independent productions and possible support measures thereto (from a media diversity and media pluralism angle), in light of a report to be prepared by a working group set up within the MC-S-MD.

Concerning the last point, the Bureau noted that the group considers it necessary to follow closely the ongoing revision of the European Convention on Transfrontier Television with a view to avoiding any normative conflict or overlap.

(iii) Group of Specialists on public service media in the information society (MC-S-PSM)
The Bureau noted action being taken or planned in respect of the group’s terms of reference as follows:

(i) a questionnaire will be sent to CDMC members to prepare a compendium of good practices on how member states ensure the legal, financial, technical and other appropriate conditions required to enable public service media to discharge their remit in the information society in the light of relevant Council of Europe standards (cf. item 15 of the Kyiv Plan);

(ii) the group will prepare a compendium of best practices of public service media as regards promoting a wider democratic participation of individuals, inter alia with the help of new interactive technologies (cf. item 21 of the Kyiv Plan); to this end, the MC-S-PSM decided to commission a consultant to prepare a report on the subject, as the group lacked expertise in this particular field. The group will agree on the key elements required for a draft compendium of best practices and will approve the consultant’s terms of reference at its October 2007 meeting;

Bureau members suggested, in this connection, that the European Broadcasting Union might be of assistance; finally, the Bureau stressed the advisability for coherence of this work with that of the Ad-Hoc Committee on e-Democracy (CAHDE) and for synergies to be developed to this end;

(iii) the group proposes to elaborate in 2008 a draft report on the contribution of public service media in increasing the transparency of public authorities and facilitating their scrutiny, and the issue of transparency and accountability of public service media themselves (cf. item 22 of the Kyiv Plan);

(iv) the group will prepare, by the end of May 2007, a questionnaire to be addressed to CDMC members with a view to the preparation of a draft report on the contribution of public service media to the implementation of the Committee of Ministers Recommendation No (97)21 on media and the promotion of a culture of tolerance (cf. item 13 of the Kyiv Plan).

(iv) Group of Specialists on human rights in the information society (MC S IS)
The Bureau noted action being taken or planned in respect of the group’s terms of reference (in addition to the two draft instruments and report considered under item 4.f. below) as follows:

(i) a report and possible draft standard-setting instrument on the use and impact of technical filtering measures for various types of content in the online environment, with particular regard to Article 10 of the European Convention on Human Rights (cf. items 19 and 23 of the Kyiv Action Plan), to be submitted to the CDMC in time for its November 2007 meeting;

(ii) examining the protection of intellectual property rights in the new communication and information environments (and the Internet) principally from the angle of user generated content, having regard to the fundamental right to freedom of expression and free flow of information (cf. item 18 of the Kyiv Action Plan), to be submitted to the CDMC in time for its spring 2008 meeting;

the approach adopted by the group in respect of this item of its terms of reference was welcomed by some Bureau members;

(iii) tools to assist key state and non-state actors in their practical understanding of, and compliance with, human rights and fundamental freedoms in the Information Society (cf. items 19 and 23 of the Kyiv Action Plan) - practical guidelines for certain key Internet actors to be submitted to the CDMC in time for its November 2007 meeting;

(iv) the respect for human dignity in the new communication services and possible proposals for further action to complement or reinforce existing standards in this area (cf. item 27 of the Kyiv Action Plan), to be submitted to the CDMC in time for its Spring 2008 meeting;

(v) a standard-setting instrument to protect children from harmful content when using new communication technologies and services and the Internet, while ensuring freedom of expression and the free flow of information (cf. items 17, 19 and 23 of the Kyiv Action Plan), to be submitted to the CDMC in time for its Autumn 2008 meeting;

(vi) follow-up to Recommendation Rec (2006)12 on empowering children in the new information and communications environment (cf. items 23 of the Kyiv Action Plan) – online workspace to be set up by summer 2007 which targets dialogue and exchange primarily between the participants of the Council of Europe Pan-European Forum on empowering children and young people in the new information and communications environment (Yerevan, 5 and 6 October 2006).

Work programme for the CDMC in 2007

The Bureau noted the risk of facing unduly heavy agendas at one or both of the CDMC meetings in 2008, and asked the groups of specialists to ensure that, if possible, they spread out evenly over 2007 and 2008 their output requiring CDMC consideration and possible transmission to the Committee of Ministers. It also observed that account should be taken of the work that the preparation of the First Ministerial Conference on Media and New Communication Services will involve.

Working methods of the CDMC

The Bureau suggested that it is no longer necessary to keep this item systematically on the CDMC agenda. Working methods will of course be discussed regularly in the context of specific issues or needs. With this in mind, the Bureau examined, together with this, item 7.i. of the agenda, namely promoting the visibility of the work of the CDMC, and decided to put this specific question on the agenda for the next CDMC meeting.

The Bureau requested that the Secretariat invite the Council of Europe Director of Communication to the next CDMC meeting when this item will be discussed.

More particularly, the Bureau considered that it was necessary to review certain practices and explore ways in which to ensure the desirable degree of visibility to CDMC work, in the interest of the broadest dissemination and impact of Council of Europe standards on freedom of expression and information and freedom of the media.

The Bureau suggested several possible aspects to explore:
(i) strategies at the Council of Europe Secretariat level, including as regards the use being made and potential of the internet;
(ii) measures at member state level, with particular reference to posting relevant information and providing links in relevant Ministries’ web sites;
(iii) the potential contribution of civil society organisations and, more particularly, CDMC and groups of specialists’ observers.

On the more general question of measuring the impact of CDMC work, the possibility was raised of encouraging relevant authorities to mention in the preamble to legal texts the Council of Europe standard setting instruments from which inspiration was drawn or which are implemented in the piece of legislation concerned, and to provide feedback on the use made of such standards (e.g. through CDMC members).

Draft instruments or texts submitted by the Groups of Specialists for consideration by the CDMC

The Bureau decided that, subject to certain changes, the texts submitted by the groups of specialists be examined by the CDMC at its next meeting, namely:
(i) draft guidelines on protecting freedom of expression and information in times of crisis (cf. items 1 to 3 of the Kyiv Action Plan);
more particularly, the Bureau decided that the preface be taken out of this draft document and be proposed as a foreword (e.g. by the Secretary General) to a future published version of the guidelines). Further, the appendix should be regarded as a background information document attributable as appropriate to the MC-S-IC, the Secretariat and the consultant who contributed to its preparation; the appendix should therefore not be submitted to the CDMC for approval (although comments by CDMC members would be welcome);

(ii) draft declaration on the protection and promotion of investigative journalism (cf. item 29 of the Kyiv Action Plan);

(iii) draft recommendation on promoting freedom of expression and information in the new information and communications environment (cf. items 17.i, 19 and 24 of the Kyiv Action Plan);

(iv) draft recommendation updating Recommendation No. R (99)15 on media coverage of election campaigns (cf. item 26 of the Kyiv Action Plan) in the light of digital broadcasting services and new communication services; and

(v) report on the implementation by the member States of the 2003 Declaration of the Committee of Ministers on freedom of communication on the Internet.

Bureau members welcomed these texts and expressed the desirability that (i) to (iv) be approved at the next CDMC meeting for transmission to the Committee of Ministers with a view to their adoption and that (v) serve to inform the Committee of Ministers of the situation in the sixteen member states that have replied to the questionnaire and that, at least in those countries, there appears to be general adherence to the provisions of the Declaration. Bureau members were invited to provide any additional comments they had and concrete drafting proposals within the week following the Bureau meeting; the drafts should then be circulated to all Bureau members for comments/approval within 48 hours with a view to the rapid dissemination of the documents in question to all members.

Implementation of Council of Europe standards on media and freedom of expression

(i) Implementation of non-binding instruments prepared under the authority of the CDMC

The Bureau decided that, if possible, the draft document on the implementation by member states of Recommendation (2000) 23 on the independence and functions of regulatory authorities for the broadcasting sector which is currently under preparation be finalised for consideration at the next CDMC meeting. This will allow the CDMC to decide upon any further action to be taken on the subject.

Further, it noted with interest that the next meeting of the European Platform of Regulatory Authorities will also focus on this issue; it asked the Secretariat to take account of relevant discussions at that forum.

(ii) Discussion of a possible future mechanism for promoting respect of Article 10 of the European Convention on Human Rights

The Bureau decided that the expanded discussion paper prepared by the Secretariat be distributed to CDMC members together with concrete questions that will provide a clear idea as to the degree of support that a Council of Europe mechanism on freedom of expression and information and freedom of the media would receive from member states. To the extent possible, CDMC members should provide their answers to those questions to the Secretariat before the next Steering Committee meeting.

In this context, the Bureau noted that, at its next meeting, the CDMC should provide a response to the calls made by PACE in its Recommendation 1783 (2007) on the threats to the lives and freedom of expression of journalists to “establish a mechanism for identifying and analysing attacks against journalists and other serious violations of media freedom in Europe, with a view to developing policy recommendations to member states on how to better protect journalists and the freedom of the media” and that expressed in broader terms in PACE’s Recommendation 1791 (2007) on the state of human rights and democracy in Europe to “establish a specific mechanism on freedom of expression and media tasked with the specific mandate to monitor the situation of freedom of expression and of the media in Council of Europe member states and to suggest corrective measures”.

The Bureau decided to invite to an exchange with the CDMC the Executive Secretaries of the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment (CPT) and of the European Commission against Racism and Intolerance (ECRI), the Secretary of the Advisory Committee of the Framework Convention on National Minorities and secretariat members involved in the elaboration of the Council of Europe Convention on Action Against Trafficking in Human Beings (under which the Group of Experts on Action Against Trafficking in Human Beings (GRETA) will be established once the convention enters into force). The Bureau also considered it desirable to seek the views of the Registry of the European Court of Human Rights on the desirability of a mechanism in respect of Article 10 and/or invite a representative of the Registry to take part in the above-mentioned exchange with the CDMC.

Internet governance and implementation of the WSIS action lines

(i) Contribution of the Council of Europe to the Internet Governance Forum (Rio de Janeiro, 12 to 15 November 2007)

(ii) Implementation of the World Summit on the Information Society action lines regarding the media (C9) and the ethical dimensions of the Information Society (C10)

The Bureau requested that the Secretariat inform the CDMC of these matters at the next meeting.

It also noted with interest that the 2007 IGF is likely to include the same themes as the 2006 Forum (openness, security, access and diversity) and reiterated their close links to the Council of Europe’s own objectives and mandate. It welcomed the work being carried out by the Secretariat in contributing to the IGF process and to the follow up to the WSIS. In respect of the latter, it noted in particular that Messrs Karol JAKUBOWICZ, former Chairperson of the CDMC, and Christian S. NISSEN would participate on behalf of the Council of Europe in an event on the public service value of the internet and public service media, within the framework of action line C9.

The Bureau recalled that, according to its terms of reference, the MC-S-IS should follow Council of Europe work in these fields.

First European Ministerial Conference on the Media and New Communication Services (Reykjavik 2009)

The Bureau decided to propose to the CDMC:
(i) to accept the invitation of the Icelandic authorities to hold the First European Ministerial Conference on the Media and New Communication Services (Reykjavik), in the spring of 2009;
(ii) to propose to the Icelandic authorities that the Ministerial Conference be held on Thursday 14 and Friday 15 May 2009, with possible alternative dates one week earlier (Thursday 7 and Friday 8 May 2009) and one week later (Thursday 21 and Friday 22 May 2009);
(iii) to propose to the Icelandic authorities that a final CDMC preparatory meeting be held in Reykjavik on the eve of the Ministerial Conference;
(iv) to propose to the Icelandic authorities that a civil society or non-governmental organisations’ forum be held in Reykjavik on the eve of the CDMC preparatory meeting, and that civil society be placed in a position to “speak to ministers” during the Conference, following the experience of the last Ministerial Conference;

The Bureau considered that the question of format of the meeting and theme(s) should already be discussed by the CDMC at its next meeting.

While the Bureau recognised that a Ministerial Meeting involves certain restrictions (e.g. as regards offering ministers a real possibility of expressing their views and taking decisions as to future lines of action), it considered it desirable that there be real debate among participating ministers. In this context, the possibility of shorter plenary periods leaving sufficient time for thematic ministerial round tables was evoked. The Bureau also suggested that certain documents prepared in advance could be earmarked for adoption without discussion, leaving more time for subjects meriting real debate among ministers. CDMC members might wish to see with relevant ministers or ministries whether these approaches would be acceptable.

As regards themes, there was consensus that certain ongoing topics might be unavoidable (e.g. threat to freedom of expression and freedom of the media in crisis situations, inter-cultural and inter-religious dialogue) and that new information and communication services and technologies should feature prominently in the Ministerial Conferences programme.

The following other topics were briefly mentioned: ethics, human dignity (with particular reference to emerging Internet facilities, e.g. alternative virtual lives) and user generated content. Reference was also made to the need to pursue efforts to interpret human rights in the new information and communications environment and of the capital importance of freedom of expression for democracy and, related to the consideration of an Article 10 mechanism, the issue of making freedom of expression and information and media standards work.

The Bureau also signalled the need to remain attentive to Council of Europe priorities generally and those signalled by the Parliamentary Assembly of the Council of Europe

Finally, the Bureau exchanged views on the need to ensure adequate visibility for the Ministerial Conference, particular reference being made to fringe events (e.g. broadcasted debates/round tables) and to full use of communication services and technologies (e.g. live webcast, real time Internet transcript, contemporaneous blog).

Intercultural Dialogue

The Bureau requested that relevant members and the Secretariat inform the CDMC at its next meeting of work undertaken by the Council of Europe in this area (progress as regards the preparation of the White Paper on Intercultural Dialogue, outcome of the San Marino Conference and work of the Steering Committee for Human Rights). It decided that relevant reports by CDMC members taking part in other Council of Europe activities be made available to all Steering Committee members.

Information on the work of, and co-operation with, other Council of Europe bodies, of interest to the CDMC

The Bureau confirmed that, resources permitting, it would be desirable for Bureau members to continue to take part in relevant meetings of other Council of Europe bodies, notably Ms Bissera ZANKOVA (DH-DEV, reporting to the CDDH) and Ms Delia MUCICA (DH-SAC also reporting to the CDDH, and CAHDE). It also decided that Frederic RIEHL take part in a meeting of the Cybercrime Convention Committee (T-CY).

It welcomed that a meeting of education and media specialists is being organised on 11 June 2007 to discuss the question of media education. The meeting is being organised jointly by the secretariats of the Steering Committee on Education (CD-ED) and the CDMC. From the media angle, the Chairperson of the CDMC will take part in the meeting together with three other experts yet to be selected.

The Bureau also took note that the Chairperson had been invited to a meeting, convened by the Secretary General and chaired on his behalf by the Director General of Human Rights, of the Chairpersons of various Council of Europe committees, where the Organisation’s current work against terrorism and possible follow-up were discussed.

Assistance and Technical co-operation programmes being implemented by the Media Division

The Bureau decided that, in line with the views expressed by the CDMC, this item be removed from the CDMC’s draft agenda for the 5th meeting, but should be included in the agenda for the 6th meeting (i.e. only once a year).

Administrative and budgetary matters

The Bureau was informed of the change in name of the Media Division, to Media and Information Society Division, and other changes to the Secretariat staffing. The Bureau was pleased to note that the budget allocated to activities related to the CDMC work in 2007 had not experienced significant change as compared to 2006.

Dates of the next meeting

The Bureau noted and confirmed the dates for its next meeting, namely 18 and 19 October.
