Activity Synopsis

 
Objective(s):

Target group: Ukrainian judges, lawyers and journalists

The main targets of the seminar were the same as in the previous seminars on Article 10: to present an overview of the case law of the European Court of Human Rights on Article 10 of the European Convention on Human Rights; to discuss the practice of Ukrainian Courts in the cases concerning the mass media (with special regard to defamation, insult, criticism of public figures); to present the European and relevant Ukrainian practice in the access to information, protection of sources, state secrecy and whistle-blowing; to raise awreness of the implementation of Article 10 of the European Convention on Human Rights and the relevant case law on this Article; to present concrete examples from current practice and prepare a case study in the workshop with the participants of the seminar; to define the perspectives for the Ukrainian judges’ implementation of European standards in their practice.
 

Output/Results:

The participants of the Seminar, and in particular, the judges from Mykolaiv, shared their experience on the implementation of ECHR norms and standards in their practice.

The participants of the seminar stressed the importance of receiving the necessary information and documents on the implementation of the ECHR, and in particular Ukrainian versions of the text of the ECHR, case law of the European Court of Human Rights on Article 10 of the Convention, collection of recent decisions of the European Court on Article 10, analysis of Ukrainian legislation in the context of the implementation of the ECHR.

Three role games demonstrated that the judges had mastered the material which was the subject of the seminar.

Due to the participation of journalists in the seminar, it was possible to present concrete problems concerning freedom of expression in the Ukrainian context.

The regional journalists (including radio journalists) prepared the materials concerning Seminar for the spreading in the media sphere.

According to the questionnaire, the Seminar was successful and useful for the participants.


 

Conclusions/Follow Up:

The proposal to publish the decisions of the Ukrainian courts referring to the European Court of Human Rights, in particular the implementation of Article 10 is advisable.

The selection of the well-qualified judges for the next trainings and improvement of their qualification in the ECHR case law was continued, as during previous seminars.

Judges from the district (local) and appeal courts from 4 regions of Ukraine (Odessa, Kherson, Mykolaiv, ARC (Autonomic Republic of Crimea), lawyers dealing with cases concerning freedom of expression, journalists.
