Activity Synopsis

 
Objective(s):

To examine and approve view a view to transmitting to the CM for adoption:
- a draft declaration on the management of the digital dividend and the public interest
- a draft recommendation on media complaints bodies, their operation and procedure
- a draft recommendation and report on measures to promote respect for freedom of expression and information with regards to Internet filters
- a review of the implementation of the CM Rec(2000)23 on the independance and functions of regulatory authorities of the broadcasting sector
- a draft statute for an award for media which have made an outstandig contribution to conflict prevention or resolution, understanding and dialogue
- a possible strategy to encourage training of media professionals in order to provide professional and independant coverage of crisis situations
-a forum on the rights and responsibilities and work conditions of journalists and an information network on the media's contribution to inter-cultural and inter-religious dialogue

To adopt draft comments on three PACE Recommendations (1805(2007) on Blasphemy, religious insults and hate speech agains persons on the ground of their religion, 1799(2007) on the image of women in advertising and 1814(2007) towards decriminalisation of defamation.) for transmission to the CM

To examine a proposal by the Bureau for a study on legal developments in Member States in recent years with regards to freedom of expression and information in the context of the fight against terrorism.

To further discuss the feasibility of a possible future mechanism for promoting respet of Article 10 of the European Convention of Human Rights

To discuss a possible CoE Convention on the protection of the neihgbouring rights of broadcasting organisations

To examine the work of the groups of specialists in 2007 and their plans for 2008

To examine the application by the NGO CMFE for an observer status with CDMC and groups of specialists and to make a decision

To examine the work programme of the CDMC in 2008 and particularly the preparation of the 1st European Minisiteria Conference to be held in Reykjavik in 2009.

To discuss themes and sub-themes of that conference on the basis of the preliminary outline prepared by the Bureau.

To examine results to a questionnaire sent to members on visibility given to CoE work and standards.

To examine the results of the participation of CoE to the Internet Governance Forum (Rio 12-15/11/07), of the joint CoE/UNESCO conference on ''Ethics and human rights in the information society'' (Strasbourg, 13-14/9/07)

To elect the CDMC'c chairperson, vice-chairperson and 3 members of the Bureau 

Output/Results:

The CDMC approved and transmitted to the Committee of Ministers
- a draft declaration on the management of the digital dividend and the public interest
- a draft recommendation on media complaints bodies, their operation and procedure
- a draft recommendation and report on measures to promote respect for freedom of expression and information with regards to Internet filters
- a review of the implementation of the CM Rec(2000)23 on the independance and functions of regulatory authorities of the broadcasting sector
- a possible strategy to encourage training of media professionals in order to provide professional and independant coverage of crisis situations
- a forum on the rights and responsibilities and work conditions of journalists and an information network on the media's contribution to inter-cultural and inter-religious dialogue

The CDMC drafted, approved and transmitted to the Committee of Ministers
- a draft declaration on protecting the dignity, the security and the privacy of children on the Internet

It adopted and thansmitted to the Committee of Ministers comments on PACE Recommendations (1805(2007) on Blasphemy, religious insults and hate speech agains persons on the ground of their religion, 1799(2007) on the image of women in advertising and 1814(2007) towards decriminalisation of defamation.

The CDMC decided to launch a thematic study on legal developments in Member States in recent years with regards to freedom of expression and information in the context of the fight against terrorism.

It decided that the NGO Community Media Forum Europe (CMFE) will have an observer status with the group of specialists on media diversity (MC-S-MD) for one first year.

It discussed the feasibility of a possible future mechanism for promoting respect of Article 10 of the European Convention of Human Rights and decided to examine the feasibility of a light option drawing on existing institutions.

It decided to ask the Committee of Ministers to give terms of reference for a drafting group for a CoE Convention on the protection of the neihgbouring rights of broadcasting organisations

In the light of the work accomplished, the CDMC decided not to request the Committee to extend the terms of reference of the group of specialists on media in times of crisis (MC-S-IC).

It decided to engage in work on intercultural dialogue and in particular, in the preparation of a publication on the media’s contribution to “living together”.

It decided to ask the Secretariat to pursue contacts with various prize-giving organisations (e.g. Prix Europa) to support the projet of an award for media which have made an outstandig contribution to conflict prevention or resolution, understanding and dialogue, and to take due account of action foreseen in the Council of Europe Whitepaper on Intercultural Dialogue once it has been adopted.

First European Ministerial Conference on the Media and New Communication Services (Reykjavik, foreseen on 28 and 29 May 2009): the CDMC approved “Trust in Today’s and Future Media” as possible overarching title for the Conference and called members for contributions and submissions to the content.

The CDMC elected Mr. Matthias Traimer (Austria) chairman, Ms delia Mucica (Romania) vice-chairperson and Messrs Garegin Chugaszyan (Armenia), Frédéric Riehl (Switzerland) and Luis Santos Ferro as Bureau member (Portugal) as members of the Bureau. 

Conclusions/Follow Up:

Following texts will be considered for possible adoption by the Committee of Ministers:
-in January 2008:
the draft Declaration on the management of the digital dividend and the public interest
. the draft declaration on protecting the dignity, the security and the privacy of children on the Internet.
- in March 2008
. the draft Recommendation and report on measures to promote respect for freedom of expression and information with regards to Internet filters
. the draft Recommendation on media complaints bodies, their operation and procedure
. the review of the implementation of the CM Rec(2000)23 on the independance and functions of regulatory authorities of the broadcasting sector
. the possible strategy to encourage training of media professionals in order to provide professional and independant coverage of crisis situations
. a forum on the rights and responsibilities and work conditions of journalists and an information network on the media's contribution to inter-cultural and inter-religious dialogue

A thematic study on legal developments in Member States in recent years with regards to freedom of expression and information in the context of the fight against terrorism will be launched with first results expected at the end of the first term of 2008.

After the Committee of Ministers has given terms of reference for a drafting group for a CoE Convention on the protection of the neihgbouring rights of broadcasting organisations, the Secretariat will organise the drafting work with national experts.

The Secretariat will consult with the relevant Council of Europe bodies in view of assessing the feasibility of a ''light'' instrument for promoting respect of Article 10 of the European Convention of Human Rights and report to the CDMC.

The Secretariat will synthesise the contributions from member states to the content of the First European Ministerial Conference on the Media and New Communication Services (Reykjavik, foreseen on 28 and 29 May 2009) in view of further preparation work of the Bureau and then CDMC.
