Expertise on normative decrees and instructions governing penitentiary institutions, for their compatibility with provisions of the European Convention on Human Rights. |
| Description: |
A working group of five Russian experts and two foreign Council of Europe experts has been set up, to examine the respective normative and sub-normative legal acts governing penitentiary institutions, and select those relating particularly to ''freedom of correspondence'' as falling among the rights protected under the European Convention on Human Rights. Following a legal expertise in writing a Round-table is to take place in Moscow at the end of 2002. The objective of the Round table is to discuss issues with strong human rights implications (e.g. the concept of ''isolation'' and its implementation in Russia and other Council of Europe member states). More in detail the working group will examine the comments of the CoE experts. That will be done together with representatives of different institutions associated with the Minsitry of Justice, as well as with the active input of regional ombudsmen (in view of their substantial role as human rights guardians and the possiility of them having legislative initiative). A follow-up meeting (in Strasbourg) is planned for the first part of 2003 to round up the findings and recommendations, on the basis of which the Russian working group will be able to produce a paper of recommendations to the provisions shaping the system currently in force. The definitive outcome of the project is potentially likely to result in legislation changes.
